The China sends the poor defectors back to the North Korea

We greatly need your help on the avoidance ethical responsibilities on the part of the Chinese authorities who are forcibly to repatriating the North Koreans who absconded from their home country. If they do, Kim Jung-il, the brutal dictator would kill North Koreans in an inhumane way.
The Public Security Bureau in China has been reinforcing the crackdown on North Korean refugees as well as apprehending them around the Northeastern Chinese city of Shenyang and Dandong. The authorities made a determined attempt to send the twenty poor North Korean defectors back home. We should protect these poor refugees. However we couldn't deter China from an action because of China's self-righteousness.
Russia delivered the seven defectors who were caught smuggling into Russia over to China in 2000. At the time, China gave assurances to a humane way of handling them at but in the end, the China sent them back home to North Korea, even though they were granted Refugee Status from the U.N. High Commissioner for Refugees (UNHCR). We have called on China to stop sending them back home, emphasizing the fact that the refugees might be brutally persecuted, killed or tortured. Nevertheless the China has been sending them back home over again and over again for the last decade, each time, waiting for the noise from the international community to die down before sending the refugees back home.
China outwardly claims that they would follow domestic and international laws standing for humanitarian principles. But their actions do not demonstrate their outward support. If the refugees get into the Embassy of South Korea in China, then China will send the refugees to the South Korea. But if the refugees are unable to make it to the South Korean embassy, or like in the Russia case, then China will send those refugees back to North Korea.
The China sends the poor defectors who got arrested on the spot, outside of the jurisdiction of South Korea back to the North by a treaty with North Korea to repatriate defectors back to their country of origin.  It is a violation of humanitarian conventions. Convention relating to the Status of refugees is defined as “Not returning an asylum seeker to a country to face persecution”. The refugees China sends back to the North is obviously a violation of Convention Relating to the Status of Refugees. We appeal to all supporters of the fundamental human rights to involve in launching a drive against the Chinese authorities' inhumane act. The action guides are intended let the authorities to help end the humanitarian injustice and suffering on the part of the North Korean refugees.

- We, as signers of Convention Relating to the Status of Refugees, have a duty to condemn China for their violation of humanitarian conventions. If you find illegal Chinese Immigrants, please report to your Immigrant Service Agency. Put themselves into the others' shoes, so let them realize what they have done is a crime against humanity.
- Please let all the people know, "Do not buy Chinese products" till the Chinese authorities stop their inhumane act.
- Please appeal to your government to deny entry into your country to any senior leader of the Chinese government and members of their family who has participated in the trafficking of North Korean refugees, the forcible return of refugees to North Korea.
- Please ask all media, newspaper and press coverage to "Please, stop the Chinese authorities' inhumane act.”
- Please call the Chinese Embassy in your country and make a strong protest against the Chinese authorities' inhumane act.
 
 
If the Chinese authorities caught and sent North Korean defectors back home, Kim Jung-il, the brutal dictator, would kill them in very cruel ways. Many countries' efforts to improve North Korea Human Rights can save the poor North Korean refugees from a horrible death and a gruesome tortures. And, please remember, your attention and participation may be a life-saving option and can create a more prosperous, healthier and better world.

“중국 정부 규탄 및 탈북자 북송중지” 를 위한 우리의 행동

우리는 중국 정부를 규탄하고 체포된 탈북자들의 북한 송환을 저지하기 위하여 ‘세계인권단체’ ‘국·내외 언론사’ ‘각 국 정부수반’ ‘미·영 국회의원’ ‘한국미국한인회 각 지부대표’ ‘교민 언론사’ ‘한국 주재외국대사관’에 중국 정부의 비인도적인 행위를 알리고자 영문협조문 서한을 작성하여 발송 하였다.
 
“중국 정부의 비인도적인 탈북자 송환(죽음)을 막기 위하여 귀하의 도움을 절실히 필요로 하고 있습니다.”
 
중국 정부가 동북 3성에서 머물고 있는 탈북자들에 대한 집중 단속을 통해 선양·단둥 등에서 탈북자들을 대거 체포하였으며 이들 중 지난달 체포한 탈북자 20여명을 북송하려 하고 있습니다. 탈북자들은 한국 정부가 헌법상 보호해야 함에도 불구하고 중국 정부의 독선으로 인하여 북송을 번번이 저지하지 못하고 있는 실정입니다.
2000년에도 중국 정부는 중국 땅을 거쳐 러시아로 밀입국했다가 체포된 탈북자 7명을 러시아로부터 인계받았습니다. 처음에 중국은 '인도적 처리'를 다짐했으나 결국 북송을 하고야 말았습니다. 북송된 탈북자들은 유엔난민고등판무관실(UNHCR)로부터 난민 지위를 부여받은 상태였습니다.
이에 한국은 북한으로 돌려보내진 탈북자들이 처형·고문 등 박해를 받는다는 사실을 강조하며 북송을 멈춰 달라고 계속해서 요청하고 있으나 중국은 탈북자를 체포한 후 국제사회 여론이 잠잠해지기를 기다려 북송하는 관행을 10여 년간 되풀이 하고 있습니다.
중국이 대외적으로 밝히는 탈북자 처리의 3대 원칙은 국내법, 국제법, 인도주의 원칙에 따른다는 것입니다. 그러나 실제로 이 세 가지 원칙은 상황에 따라 다르게 적용되고 있습니다.
중국은 주중 한국대사관이나 총영사관처럼 한국의 관할권이 인정되는 지역에 들어간 탈북자에 대해서는 인도주의 원칙에 따라 한국행을 허용하고 있습니다. 그러나 그 밖의 지역에서 체포된 탈북자는 중국 국내법과 북·중 간 조약에 의해 북송하는 것을 원칙으로 삼고 있습니다.
중국 정부가 난민 협약 당사국으로 북한 당국의 박해를 받아 탈출한 탈북자를 북한에 돌려보내는 것은 협약 위반 입니다. 난민 협약은 어떠한 방법으로도 난민의 생명이나 자유가 위협받을 우려가 있는 영토로 추방하거나 송환하는 것을 금지하고 있습니다. 중국 정부가 탈북자를 강제 북송하는 것은 명백히 “난민 협약에 위배되는 것" 이므로 전 세계인의 보편적 인권을 지지하는 모든 사람들은 이러한 중국 정부의 비인도적 행위를 저지하기 위하여 행동으로 참여해 주실 것을 호소 합니다.
 
중국 정부가 탈북자들을 죽음으로 내모는 “북송행위” 행동을 멈추게 하기 위하여 아래와 같이 행동하고 실천하여 주시길 바랍니다.

- ‘난민 협약 당사국’ 가입국의 국민들은 각 국의 국내법에 의거 ‘중국의 불법체류자‘ 들을 이민 당국에 신고하여 주십시오. 그들은 자신들의 정부가 반인륜적인 범죄를 저지르고 있다는 현실을 깨달아야 합니다.
- 중국산 제품 등을 구입 하지 말아 주실 것을 주위에 알려 주십시오.
- “북송행위”에 관련된 중국 관리들의 입국을 제한 할 수 있도록 정부에 호소하여 주시기 바랍니다.
- 각종 뉴스나 언론매체에 중국 정부의 비인도적인 행위를 중지해 달라고 보도를 요청해 주십시오.
- 자신이 살고 있는 곳의 중국대사관에 전화하여 비인도적인 탈북자 “북송행위” 를 중지해 달라고 항의를 해주십시오.
 
이러한 많은 분들의 노력들은 고통과 억압으로부터 생존 하기 위해 북한을 탈출한 탈북자들이 중국 정부에 의해 다시 북한으로 보내져 보복을 당하거나 피할 수 있는 죽음으로부터 벗어 날 수 있는 기회를 줄 수 있습니다.
많은 분들의 관심과 참여가 꺼져가는 생명을 살리는 일임을 명심하여 주시길 당부 드립니다
